I continue to hope they will go all in.
It appears that four of the players had sex with a woman. Those four were the ones initially suspended pending the police investigation. When the investigation cleared them of criminal wrongdoing, they were reinstated.
There were also 6 bystanders (I could be wrong -- it could be 5 and 5). One of the bystanders recorded the encounter and shared it. It was probably a good thing someone recorded it because it was definitive in clearing the players in the eyes of the law.
The girl was drunk. As were, presumably, the football players.
Minnesota prohibits sexual assault as part of its student conduct code.
Sexual conduct requires affirmative consent. If none is given, then it's sexual assault.
Under the Minnesota code (and many others as "required" by the DOJ): "Consent is not obtained where: ...There is incapacitation due to the influence of drugs or alcohol."
Everyone stipulated that she was drunk. The initial report likely concludes that there was no affirmative consent because she was drunk. Thus, there was a sexual assault as defined by the University Code of Conduct.
The University will expel the 4 students who committed the "sexual assault." They will expel the student who recorded it. They will suspend the other 5 bystanders for a year.
The football team is protesting this basic set of facts. Four students will be expelled and labeled as sexual predators for having what was probably consensual sex in the the non-academic world.
I think that the entire issue is very much worth protesting I don't think the public at-large understands how Universities handle sexual assault cases. I think they ought to.
Finally, I'm not one to judge what you do behind closed doors. If you want to engage in a consensual gangbang, then whatever. Personally, I find it gross, but I hate to be the morality police.Dan Patrick: What was your reaction to [Urban Meyer being hired]?

So you are basing your opinion upon bare allegations in a complaint? I would have expected a heightened level of skepticism from an attorney. (And by "complaint" I am referring to the court pleading filed by the Plaintiffs, not a "complaint to authorities or school officials". For the Minnesota matter, there is no court pleading. For my post I put together known facts + inferences. I could obviously be wrong, e.g., about why the University found no consent. My best guess based on what the facts appear to be is what I set forth -- that she was drunk/incapacitated and couldn't consent per University standards of affirmative consent. That certainly explains why a video would be criminally exculpating and why they could still be found to have violated the student code for sexual assault.
The Findlay case is obviously written from the perspective the Plaintiffs. That one I'd definitely want to read the Answer.Dan Patrick: What was your reaction to [Urban Meyer being hired]?
