No it isn't It's much greater than that. Civil liability cannot restore the damage done to Sandusky's victims. it can only compensate them with money. Only two administrators face criminal charges.. The Freeh report makes it clear that the steps taken by the University were to protect the football program. The Big Ten and the NCAA must step up and impose a penalty that makes sure other programs don't put the "reputation" of its sports program above the safety of victims abused with their knowledge. People seem to be forgetting that that is all Penn State was worried about--it's "reputation" Not the integrity of its program, not the integrity of the University not the integrity of its employees- just it's "reputation". To suggest that those who demand that the University pay for this horrendous cover-up display a "knee-jerk reaction" is not only wrong but shows as aware a lack of concern for the full extent of the harm committed by the University. Once has to understand two points--first and foremost any legal entity is liable for the acts of its employees and second these were acts of the highest ranking employees in the University. The Big ten has an opportunity to show that it truly believes in the virtues it espouses. Failing to act only proves that Delaney and others only care about the bottom line. If PSU had any integrity (and this cover-up of the worse scandal in the history of college football proves they don't) they would fall on their sword as they shout their hollow motto of "Success with Honor".
Penn State is going to be punished through the civil and criminal courts. They are the current subject of Federal-level investigations.

Under what authority do you believe the NCAA should take action? Cite specific rules that Penn State broke. You can't even begin to talk about LOIC until you can specifically list the NCAA violations that took place.

You're asking that the NCAA create a new authority for itself and take on a completely new role if you demand they take action on this matter. The same NCAA that is inept, understaffed, biased, inconsistent, and which lacks any legal power of subpoena. You want them to invent a new power for themselves on the fly and come down as hard as possible? You're opening a Pandora's Box of trouble and ushering in a new, even more inept Age of NCAA stupidity.

And again, this is a scandal first and foremost of COLLEGE ADMINISTRATION. This is not a first and foremost a football program scandal, even if the employee at the center of it all was a football coach. If the most respected Prof. in the Engineering Dept. turned out to be a pedo and PSU's administration had covered that up, it would be an ADMINISTRATION PROBLEM, not a "problem of corruption throughout the Engineering program from top to bottom which must result in the complete eradication of the department".

    • tony you're the one who posted "The CoPO wants a lynching, not fair and dispassionate justice." As I stated the court of public opinion wants accountability not a lynching.

Hey moron read my posts! I cited specific NCAA bylaws that Penn State may have violated. But once again, one expects an Oshitu fan to post such senseless crap.

        • "Here's the mission statement of the NCAA. Tell me where this case is related to it."

Uh..gee.. the "mission statement" has nothing to do with the "authority' of the NCAA. The actual bylaws of the NCAA define their "authority" the same as the actual statutes define the authority of any state or the Federal government.

The ethics clause? That's your entire basis? That's not an NCAA rule.

The bylaw right before that (2.2.2) states:

It is the responsibility of each member institution to establish and maintain an environment that values cultural diversity and gender equity among its student-athletes and intercollegiate athletics department staff.

Would you also suggest that the NCAA has the power to give the death penalty to schools that do not adequately promote "cultural diversity"?

            • Uh..... gee.. moron the ethics clause is a bylaw. Do some legal research moron before you attempt to speak on legal issues. But then again what would one expect from a fan of Oshitu?

              • BTW. Just in case you want to question my motives, I am a survivor of sexual abuse having been attacked as a child. I have had a long and painful journey to deal with it including a nasty substance abuse issue that I have dealt with on a daily basis for the last 18 years. I want to see the guilty pay fully. But just the guilty.

Answer my question. Do you believe the NCAA has the power to give the death penalty to programs that fail to promote cultural diversity as required in Bylaw 2.2.2?

                          • Stan- Do you believe Arkansas could be hit with serious NCAA penalties because Petrino violated the NCAA's bylaws on ethics?

                            Comment

                            • I think they could be sanctioned under NCAA bylaws. Especially because he hired an unqualified person for a University job with whom he had an intimate relationship that he did not disclose. Part of what you are missing is that for any organization, the acts of the employee are the acts of the organization. BTW I am not suggesting that the sanctions for Arkansas should be as severe as the sanctions for Penn State, but what Petrino did was dishonest and unethical. Anybody who has ever been involved in hiring employees knows that the only ethical thing to do is disclose any personal relationship one has with a potential hiree.

                              • Well, Okay. he didn't technically "hire " his whore. But he circumvented the hiring process at Arkansas to see that she got the job. Once again the acts of the employee are the acts of the organization. let me ask you, DSL, do YOU think arkansas can be sanctioned for the conduct of Petrino? There is no question that his actions were "unethical" when it came to hiring his whore.
