                  • Folks dismissing the seriousness of Smith's indictment, may be consciously or unconsciously rejecting larger issues that Trump's attempts to remain in power represent. Voters rejected his reelection to a second term as president in a fair popular and electoral college voting process. That and the peaceful transfer of power are bedrock principals of America's version of liberal democracy. DJT allegedly tried to undermine those principals to remain in power. That sort of thing characterizes typical authoritarian regimes. Interference in the process of free elections and the peaceful transition of power should not and does not characterize America. Smith's indictment is fundamentally about that and the larger implications surrounding it.

                    Missing that point is very much similar to missing the larger issues at stake in US involvement in Ukraine's battle to return Ukrainian territory seized by Russia to Ukraine. It's not a local battle that only involves Europeans but rather a battle of global significance that only the collective effort of the entire western world's DIB can produce a win for western liberal democracy in that critical part of the world that Ukraine is a major part of.

                      I said "most" because I haven't thought of "all" of it with enough consideration. I might be missing something. In general, the 3 counts are garbage.

                      If you're reading in your preferred media outlet -- the NYT or WaPo or whatever -- that it's a "novel" legal theory or "untested" legal theory then you have a problem. Full. Stop.

                      I'll also say this -- criminal law is enforceable to the extent it provides a flashing neon sign "DON'T DO THIS". It's not enforceable to the extent it's stretched to punish conduct we don't like. This ought to be something we all agree on -- the government ought to provide you fair notice as to what you can and can't do. Whether we create a "Trump Exception" to this, I dunno. I leave that to each person to decide.

                      • The only indictment that really should concern Trump is the one coming in GA...I don't think the Mar-A-Lago case is going to amount to much and he has a conservative judge and jury pool down there...

                          You build the case that a reasonable person would listen to the White House Counsel, Mike Pence, and Bill Barr. Anyone believing Rudy Giuliani and Sydney Powell over those guys is either insane or just willing to lie to remain in power indefinitely.

                          Pence is going to be on the stand testifying that Trump criticized him for being "too honest" when he refused to simply toss electoral votes. That's evidence that Trump understood he wanted Pence to go along with a lie.

                              Everything you said in the first paragraph is impeachable. Everything you said in the first paragraph is owed serious political repercussions. Nothing you said in the first paragraph says how it's criminal. Everything you said in the firsst paragraph explains how it's bad and, presumably, how it ought to be criminal. But, "ought to be criminal" ain't the fucking standard. CRIMINAL is the standard.

                              Like I said, IMO, everyone is going to have to decide if their is a "Trump Exception" to what ought to be a bedrock criminal law principle.
