            • I read an article over the weekend about the FISA Courts as they now function. They have a looser "probable cause" threshold for the issuance of a warrant than a standard court. In the case of the NSA, there is a blanket warrant # 1233 that allows the NSA to collect metadata. FISA pleadings are not public, but as DSL said, Trump could get the pleadings of the June and October requests and release them.

              • There isn't a looser probable cause standard. Probable cause is probable cause.

                What is different is what you are proving probable cause of. In a criminal warrant, you have to prove probable cause to believe that the target committed a crime. To get a FISA warrant, you need to prove that there is probable cause to believe that the target is an "agent of a foreign power."

                • Republicans healthcare reform is out and it's apparently a lot more 'repair' than 'repeal'. Conservative ideologues will be dared to vote against it. Supposedly, though, at least 4 Republican Senators have already said they will vote against today's proposal, meaning it probably can't pass in the current form.

                        • Trump's acceptance of the concept of universal health care guarantees that whatever Obamacare is replaced with will be just a minor tweak. It will probably be the traditional Republican approach of "we can provide this magical thing with tax cuts!"

She was shooting fish in a barrel with a fucking uzi when "The March for Science" -- some sort of thing aimed at getting more women in STEM fields -- shamefully and egregiously sent out a tweet using the word "female". Well, they learned right quick how awful that was and issued an apology.



                            A little more seriously, kudos to Middlebury for inviting a "controversial" speaker and affording him an alternative space to engage the student body when the mob chased him out of the public auditorium. Typically these leftist mobs simply want to shut down speech with their violence, but here they persisted even after the speech.                               The most enlightening part of this whole affair has been that "probable cause", in this context, isn't even a speedbump. Whatever protection the process was designed to give private citizens from being spied on by their government doesn't work.

                                Dude, you never watched Jack McCoy on Law & Order make his own rules? Heh. I mean, it depends. You have to have some facts. It's not a meaningless standard, but it's a low bar. Searches based on stops -- especially traffic stops -- are also extremely permissive. Scalia (and Thomas) routinely pushed back against governmental overreach and tried to give the 4th Amendment more teeth, often finding himself paired with the likes of Ginsburg.

                                It may be that a combination of limited spaces (the voters rejected expansion of available charter school spots in November) and sensible regulation -- if you don't perform, you're out -- we have 20 other schools that can take your spots -- may produce a really good system and alternative for kids stuck in the poor bubble.
