    Former Baltimore Police Commissioner Darryl De Sousa Sentenced to Federal Prison for Failing to File Tax Returns

    Baltimore, Maryland – U.S. District Judge Catherine C. Blake sentenced former Baltimore Police Commissioner Darryl De Sousa, age 54, of Baltimore, Maryland, today to 10 months in federal prison, followed by one year of supervised release, for three counts of failing to file individual federal tax returns. Judge Blake also ordered DeSousa to perform 100 hours of community service, and ordered him to pay restitution in the full amount of the government’s loss, which is $67,587.72. Counting payments already made, the amount still owed is $60,645.11.

    The sentence was announced by United States Attorney for the District of Maryland Robert K. Hur; Acting Special Agent in Charge Jennifer L. Moore of the Federal Bureau of Investigation, Baltimore Field Office; and Special Agent in Charge Kelly R. Jackson of the Internal Revenue Service - Criminal Investigation, Washington, D.C. Field Office.

    “As a law enforcement officer, Darryl DeSousa knew that he had a duty to file tax returns. His failure to file was a crime – not an oversight,” said U.S. Attorney Robert K. Hur. “Corrupt public employees rip off the taxpayers and undermine everyone’s faith in government.”

    “This investigation confirms the principle that no one is above the law,” said Acting FBI Baltimore Special Agent in Charge Jennifer L. Moore. “The FBI will continue to work tirelessly to make sure those in a position of power uphold the law and are held to the highest standards.”

    “IRS-CI works hard to ensure faith in our tax laws,” said Kelly Jackson, IRS-CI Special Agent in Charge. “The prosecution of those who willfully violate their known duty of filing and paying their fair share is a vital element of the IRS’ enforcement strategy.”

    According to his plea agreement, De Sousa was employed by the Baltimore Police Department beginning in 1998. De Sousa announced his resignation from BPD on May 15, 2018. On June 10, 1999, De Sousa submitted an Employee’s Withholding Exemption Certificate (W-4) to the City of Baltimore falsely claiming nine allowances for both federal and state tax purposes. By virtue of this claim, De Sousa substantially reduced the amount of taxes withheld from his salary each year. When he filed his federal and state income taxes for calendar years 2008 through 2012, he falsely claimed deductions to which he was not entitled, including for unreimbursed employee expenses when he had no such expenses, mortgage interest deductions and deductions for local property taxes when he did not have a mortgage or own any real property, and business losses when he did not operate any businesses. By virtue of these improper deductions, De Sousa fraudulently reduced the amount of taxes he owed to the Internal Revenue Service (IRS) and the State of Maryland.

    De Sousa admitted that for calendar years 2011 and 2012, he did not file tax returns at all and did not do so until 2014. When he did file returns for those years he falsely claimed unreimbursed employee expenses and donations to charity. De Sousa also failed to pay penalties and interest on those late-filed returns despite having been told to do so by the IRS. In addition, as of May 5, 2018, De Sousa had not filed taxes for 2013, 2014, or 2015, despite knowing that he had a legal obligation to do so. By virtue of the nine allowances he falsely claimed, De Sousa also owed additional money to the United States and the State of Maryland in each of those years, as he also knew.

    As a result of De Sousa’s actions, the total combined tax due to the United States and to the State of Maryland is $67,587.72.

    United States Attorney Robert K. Hur commended the FBI and IRS-CI for their work in the investigation. Mr. Hur thanked Assistant U.S. Attorneys Leo J. Wise, Derek E. Hines, and Sean R. Delaney, who prosecuted the case.

            • Things are getting messy involving the Russia, Ukraine conflict. Amid a possibly purposeful slowdown of seizure of Russian occupied Ukrainian territory, is an escalating and expanding confrontation over the now defunct grain deal abandoned by Russia.

              As to the former, I'm speculating that the inability of the UF to break through Russian defensive positions in the Sea of Azov direction (Melipitol, Mariupol) is related to the extensive, layered mines and other obstacles and the ability of the RF to employ attack helicopters in a close air support, air superiority role going mostly unchallenged by UF air defenses. Little has changed in the battle front since November of '22 with UF gains measured in meters not KMs and even those are usually temporary due to counter operations by RF. Most analysts see the current battle situation to be a static, attritional type on both sides with the UF having the advantage. That advantageous state UF presently enjoys is owing to familiarity with the terrain and the unimpeded flow of western arms to the UF compared to what is believed to be increasing resupply and logistics problems RF are facing. UF is allegedly executing a purposeful and effective strategy involving conservational and attritional tactics v. RF. That UF strategy includes targeting RF logistics, command and control centers and ammunition and fuel storage facilities while avoiding the potentially high personnel and equipment losses of direct combat with RF soldiers in fixed defensive positions. The net result is a perceived stalemate characterized by opposing UF/RF locked in to WWI style attritional battle seeking to see who caves first.

              As to the later confrontation over the Grain Deal, Russia is targeting Ukraine's ports and storage facilities in a geographically expanding way throughout Ukraine. Alternate grain storage and shipping routes are being targeted by Russian cruise missiles and reportedly doing a lot of damage. Western response is verbal outrage directed at Russia who does not care about this. Zelenski has it right that the only thing Putin responds to is force directed against him and Russia. This is nothing new but the extensive RF missile attacks and the UF's response involving targeting Russian ships in the Black Sea with water-born drones are new and definitely an obvious widening of the conflict into the potential for a significant naval battle.

              It is my view that Putin will keep testing western resolve until a collective west steps up and responds militarily. As I've posted up thread on this subject, I have no doubt that western planners have already developed and war gamed such contingencies. All that is required is the diplomatic measures required to authorize a European use of force. It does not have to be under UN or NATO Charter Article 5 but rather in the form of a well circumscribed preventative joint security process to protect Ukraine. Failing that the west will become basically useless bystanders howling at the moon as it lets Putin prove western democracies weak and incapable of mounting a Churchillian and Rooseveltian response similar to the collective effort that faced down the land grab strategy of the axis powers consisting of Adolph Hitler, Benito Mussolini and Hideki Tojo.
              Mission to CFB's National Championship accomplished. But the shine on the NC Trophy is embarrassingly wearing off. It's M B-Ball ..... or hockey or volley ball or name your college sport favorite time ...... until next year.

                        • An interesting article appeared in the Sunday edition of the NYTs. In it, the author, who spent several months traveling in Russia, reveals the mood of the Russian people with the war in Ukraine approaching 2 years in length. He wrote that feelings expressed varied from nationalistic fervor in support of it, to muted criticism. An increasingly repressive government has created a nation devoid of visible political opposition. The risks of complaining or speaking of the war’s costs are too high.

                          There are several points the author makes: One of them is that any hope of an uprising aimed at toppling Vladimir Putin is wishful thinking. Not going to happen and that, in large measure, is due to the methods the Russian regime have undertaken to silence dissent. It is all encompassing and in a historical sense approach that of the Joseph Stalin era only dressed up to appear otherwise as a liberal democratic state.
                          Another point, the lengths to which Putin’s regime has gone to paint Russia’s bare-knuckled aggression as a historical imperative are extraordinary. These include re defining Russia’s aggression in Ukraine as a patriotic undertaking to defend the Russian motherland from the infiltration of corrupt western values that the eastern expansion of NATO threatens. State media speak directly to the sinfulness of LGBTQ life and transgenderism as destructive to the moral underpinnings of a civilized society. Putin argues he is working to prevent Ukraine, which he sees as a core part of Russia, from becoming morally corrupt by western influence.

                          The older generation of Russians still attached in one degree or another to the Russian army’s victory over Nazi Germany in WWII buy into what Putin is selling. The younger generations don’t. Those that have not fled Russia, and there are hundreds of thousands of them who did flee, only furtively discuss opposition to the war in places that are safe from the intrusions of the FSB. Open-source opinion pieces expressing opposition to the war are non-existent, all of them having been shuttered within the last year with state media the only source of above ground news.

                          The salient lesson to be drawn from the author’s excellent reporting and research is that Putin has undertaken a massive propaganda program designed to shape the views of Russian society to his own. Its aim is to prepare the Russian people for a long, patriotic war with patriotism driving eligible men to join the army and fight for the motherland. Putin is quick to talk of the parallels that are present between how Russian men volunteered and fought in WWII to defeat the Nazi’s and how Russian patriots of today should fight for victory over the west.

                          It’s a dangerous situation given that Russia is a nuclear power with a psychopath having his finger on the nuclear button and we are reminded frequently of that. The present circumstances seem to dictate a long period of low level conflict and global insecurity unlike the Cold War as in this day hundreds of people are dying in Ukraine every day in a hot war that has the potential of expanding well beyond Ukraine’s boarders.
                          Mission to CFB's National Championship accomplished. But the shine on the NC Trophy is embarrassingly wearing off. It's M B-Ball ..... or hockey or volley ball or name your college sport favorite time ...... until next year.
