Today should commence the quick end to The Chairman's preposterously unconstitutional student debt cancellation decree. I can't imagine the Supreme Court upholding this and I can't really see all of the "liberal" justices united. They might unite on standing -- MIGHT. But I have a hard time seeing Kagan going along with this bullshit if she elects to get past standing.

Kind of a procedural question but if you find the states don't actually have standing, are you obliged to even address question #2?

And I just looked at the Questions Presented in the grant of cert, and standing is the first question in each case. I expect that to the be bigger battle. There's really no way to justify the substantive question. It's flagrantly unconstitutional.

Second opinion released today is amusing just because the dissent was Barrett, Thomas, Kagan, and Sotomayor. May never see those four on the same side of a dissent again.

The Jackson opinion is actually more interesting because 4 justices refused to join her section on legislative history in an otherwise unanimous opinion.

Doesn't matter...The Chairman still wins...he will claim an attempt to help the little guy and those mean MAGA judges just won't cooperate...much like the R House...even when he loses...he wins!

I just started listening but the NYT blog informed me that Sen. Warren is out on the front steps. “We cannot let the Supreme Court, an extremist court, take away the opportunity for millions of Americans to have a little racial justice, a little economic justice, a little opportunity to build more secure futures going forward,” she said.

James Campbell of Nebraska making the opening remarks on behalf of the six states brining the suit.

Missouri has a strong case for standing as it relates to MOHELA. Jackson and Sotomayor POUNCE. At issue is the fact that MOHELA hasn't brought suit but Missouri is claiming damage because they are quasi public institution that sends money earned from servicing the loans to the state scholarship program. State claims "everything MOHELA does is the performance of an essential public function."

Cancellation of the loans would reduce MOHELA's revenue by 40%.

The Nebraska guy is really taking Sotomayor to task.

So, in the early going the status of the case is this: The liberal justices clearly do not think the states have standing.

They're skeptical. The problem is that the Govt has conceded lots of other people have standing just not the State. So, the substantive issue seems like it's gonna have to get addressed sooner or later.

I would honestly think that the individuals in the next case have a little stronger standing argument than the States, especially given the broad standing conferred in, e.g., enforcing environmental laws.
