I think the subject of how to limit the likelihood that police would carry out unnecessarily violent acts in their duty to police and protect was discussed briefly yesterday or the day before. Court precedents involving qualified immunity (for liability in civil tort claims) needed to be tweaked as well as police union's work rule impacts on the ability of cities to terminate police officers for cause.

This article frames the argument for improving a city's ability to get rid of bad cops as means of saving tax payers from paying increased taxes attendant to multi-million dollar settlements by cities for wrongful death claims at the hands of police.

Like doctors, police officers could be required to carry liability insurance. Capital insurance markets, the author argues, have done a reasonably good job of making bad doctors uninsureable and therefor unable to practice. Combine that with the difficult to navigate credentialing processes - intended to prevent bad doctors, nurses and mid-levels from gaining employment in hospitals and practices associated with them - and health care is pretty well policed. Consumers of it can be reasonably assured that seeking medical care isn't going to result in care being provided by unqualified or mistake prone care providers.

The author goes on to note that tort reform in medical practice claims was required to curb the risk for medical professionals required to have malpractice insurance. Lessons learned in that environment could be pre-applied to systems like this for police officers.

The article and what I believe talent mentioned - changing the qualified immunity standard - was also touched on. I'm not sure I got from the article, though, how we go abouot doing that.
